We describe a virtue ethics approach and its application in a four-year, integrated, longitudinal, and required undergraduate medical education course that attempts to address some of the challenges of the hidden curriculum and minimize some of its adverse effects on learners. We discuss how a curriculum grounded in virtue ethics strives to have the practical effect of allowing students to focus on their professional identity as physicians in training rather than merely on knowledge and skills acquisition. This orientation, combined (...) with a student-generated curriculum, is designed to prepare students to identify and face challenges during their clinical years, further nurturing their professional growth. In short, a four-year integrated ethics and professionalism curriculum intentionally centered on cultivating virtuous physicians may alleviate, and even counteract, the effects of the hidden curriculum in the clinical years of medical training. _Confronting American Labor_ traces the development of the American left, from the Depression era through the Cold War, by examining four representative intellectuals who grappled with the difficult question of labor’s role in society. Since the time of Marx, leftists have raised over and over the question of how an intelligentsia might participate in a movement carried out by the working class. Their modus operandi was to champion those who suffered injustice at the hands of the powerful. From the (...) late nineteenth through much of the twentieth century, this meant a focus on the industrial worker. The Great Depression was a time of remarkable consensus among leftist intellectuals, who often interpreted worker militancy as the harbinger of impending radical change. While most Americans waited out the crisis, listening to the assurances of President Franklin D. Roosevelt, the Marxian left was convinced that the crisis was systemic. Intellectuals who came of age during the Depression developed the view that the labor movement in America was to be the organizing base for a proletariat. Moreover, many came from working-class backgrounds that contributed to their support of labor. World War II and the resultant economic recovery shattered this coherence on the left. How did radicals opposed to capitalism deal with a labor movement that was very successful in terms of membership and power but clearly capitalist in its orientation? Coker describes the marked ambivalence and confusion of the intellectual left in the postwar years—a period of frustration brought on by a misreading of labor militancy during the 1930s and an unsuccessful search for a radical proletarian movement. The result was a politically and intellectually weakened left for decades to come. C_onfronting American Labor_ examines four individuals who represent a cross section of postwar radicalism. Each came of age on the socialist left, expecting that an anticapitalist movement would emerge from the ranks of labor. Seymour Martin Lipset and C. Wright Mills were professional sociologists. Sidney Lens spent his early life working within the labor movement before becoming a political commentator for a variety of leftist magazines and journals in the postwar era. Historian Herbert Gutman helped to create a “new labor history” that reflected broader transformations within the intellectual left. In tracing their various approaches to the problem of labor, C_onfronting American Labor_ explores the diverse nature of the postwar left. Within the framework of pragma-dialectics, this paper analyzes the use of dissociations in the spokespersons’ replies at the press conferences held by the Chinese Ministry of Foreign Affairs between 2015 and 2017. As shown in the research results, to cut down the authority of their opponents in criticizing China and to convince the international general public of the Chinese standpoints, four subtypes of dissociation are used, which can be differentiated as: “distorted” Term I versus “authentic” Term II, “ambiguous” Term (...) I versus “univocal” Term II, “broadened” Term I versus “exact” Term II, and “narrowed” Term I versus “exact” Term II. The strategic maneuvering carried out by the spokespersons in confronting their immediate opponents by means of the various subtypes of dissociation is in the first place directed at their primary audience, i.e. the international general public. To make a convincing case, in using dissociations the spokespersons not only adapt in their strategic maneuvering to the demands of their primary audience but also in their selection from the topical potential and the presentational devices. In this article, I summarise the ontological theory of informational privacy (an approach based on information ethics) and then discuss four types of interesting challenges confronting any theory of informational privacy: (1) parochial ontologies and non-Western approaches to informational privacy; (2) individualism and the anthropology of informational privacy; (3) the scope and limits of informational privacy; and (4) public, passive and active informational privacy. I argue that the ontological theory of informational privacy can cope with such challenges fairly successfully. (...) In the conclusion, I discuss some of the work that lies ahead. (shrink)

This article focuses primarily on our research group’s year of preparation before the opening of a new K-7 publicly funded ecological ‘school’ for students aged 5–12. The article begins with a discussion of the reasons for seeking ways to change the values of a culture which fails to confront the consequences of its destructive practices, and for looking for a new approach to ecological education which sees the more-than-human world as an integral part of the learning situation. Five principles are (...) introduced and explained—principles that have grown out of the evolving experience of the research group, and then four ‘slogans’, which have served to guide the ongoing work of development, are described and illustrated. Concerning theory, it may be tempting to equate the terms "theory" and "philosophy." This commentary briefly argues that the four prima facie principles of beneficence, non-maleficence, respect for autonomy and justice enable a clinician (and anybody else) to make ethical sense of the author's proposed reliance on professional guidance and rules, on law, on professional integrity and on best interests, and to subject them all to ethical analysis and criticism based on widely acceptable basic prima facie moral obligations; and also to confront new situations in the light of those acceptable principles.

This article reviews four recently published books which help to deepen one’s understanding of the various ways white Christians (mostly in America) have often unknowingly propagated a form of Christianity that is built on a foundation of ‘whiteness’. While each book is aimed at different audiences, they collectively offer a substantive introduction to the nature of theological discourse around race and the challenges of confronting a racialised Christian mindset. Whether it is Willie Jennings’s unmasking of the white male values (...) of self-sufficiency and mastery in higher education, Miguel De La Torre’s scathing appraisal of the ways white Christians contributed to the spectacle that was the Trump presidency, Esau McCaulley’s demonstration of the valuable insights gained when the biblical text is interpreted by non-whites, or the diverse scholars gathered by Love L. Sechrest, Johnny Ramírez-Johnson and Amos Yong, it is clear that churches (and the theologians who serve them) will need to reckon with what it means to fulfil their calling in a way that faithfully attends to the concerns addressed by people from non-white backgrounds. This Article defines four distinct conceptions of cruelty found in underdeveloped form in domestic and international criminal law sources. The definition is analytical, focusing on the types of agency, victimization, causality, and values in each conception of cruelty. But no definition of cruelty will do justice to its object until complemented by the kind of understanding practical reason provides of the implications of the phenomenon of cruelty. -/- No one should be neutral in relation to cruelty. Eminently, cruelty in (...) criminal law, a human-created phenomenon, vigorously calls for responses in the form of preventive and corrective action on the part of private and public actors. It is in this sense that cruelty is a problem of practical reason, one of action preoccupied with its legal or moral obligations, rational grounds, value commitments, and actual consequences. -/- However, the connection between conceptions of cruelty and the implications practical reason can draw from the correct application of a conception of cruelty to phenomena in the world remains too detached to be able to capture and explain people's actual experiences both of seeing cruelty in the world and of confronting the question of what to do about cruelty and how to address its cultural and institutional aspects. Something is missing. -/- What is missing is the integration of conceptions of cruelty and the practical reason implications of detecting cruelty in the world into normative models which operate as meaning matrixes for cognition, meaning, and action. This Article undertakes this explanatory task through an exercise of reconstructing seminal philosophical ideas about cruelty. The result is that the four conceptions of cruelty are placed within three distinct normative models, which ultimately render intelligible legal conceptions of cruelty and legal reactions to it. Jorgensen, "Four Philosophical Models of the Relationship Between Theory and Practice" Randall Everett Allsup Teachers College, Columbia University Each of the four philosophical models that Estelle Jorgensen has put forth contests, adheres to, or adjusts the hierarchical relationships between dualities, specifically the theory and practice of musical learning. The dichotomy (...) model faces binary associations head on, splitting existence however defined into dualisms like "this/that," "us/them," and "mind/body." Models of polarity, according to Jorgensen, accommodate dualities by buffering edges, emphasizing the interconnectedness of binary relationships. The fusion metaphor is exemplified by Paulo Freire's notion of praxis in which action and reflection are welded together to create hope for a new world, one free of the oppression and conflict that is inherent in binary relationships. The dialectical model is contrapuntal by nature, Edward Said would say.1This relationship highlights our postmodern devotion to différence by embracing the tension created through inclusion so that "this is with that," "we are with them and they are with us," and "mind is with body, just as body is with mind."2Perhaps there is a fifth model, a new kind of relationship where the oppositional or hierarchical nature of binaries co-exists peacefully without tension. [End Page 104] Such an arrangement is, I think, an outgrowth of capitalist democracy—it is, most especially, representative of our global, information age. This type of relationship is problematic philosophically, we will see, lacking as Jorgensen has outlined "logic evidenced in principles," "internal consistency," and "coherence within a unity or whole." Likewise for Bennett Reimer, this new mind-set fails the test of philosophical scrutiny, unconcerned as it is with a "reasoned, structured set of propositions."3 Whether philosophy or mind-set, this new arrangement has as much to do with freedom and free markets as it does with the particular conditions of both modernity and postmodernity.In the novel, White Noise, by Don DeLillo, the postmodern condition is represented in part by an "Airborne Toxic Event," a cloud of gas, Nyodene D, which floats above a tranquil All-American college town.4 A sense of crisis is felt, but felt obliquely and no one knows exactly what harm has been done. In Albert Camus' The Plague, by contrast, the disease that infests the North African town of Oran acts to awaken its citizenry, confronting the populace with the moral imperatives to fight or flee.5 Perhaps the metaphor of quarantine symbolizes the hard boundaries of modernism.Capitalism seeks to dissolve conflict. It operates silently, in the realm of social production, like a cloud of gas. Denise, Jack Gladney's daughter in White Noise, mumbles over and over in her sleep, "Toyota Corolla, Toyota Celica, Toyota Cressida...."6 There is a sense of ontological change, that the expanding reach of media, information, and technology rewires the way we think, the way we dream. Tensions are willed away. The expansion and survival of market shares, after all, depend on the peaceful erosion of boundaries—boundaries that demarcate what we learn, what we buy, and who we are.Questions about what this new system means—this new mind-set—are explored in a book called Empire by Michael Hardt and Antonio Negri.7 These writers posit a global world of communication, cooperation, and affect, where an increase in hybrids creates a kind of "omniversality" where the virtual, natural, and ideological converge.8 In the dialectical relationship that Jorgensen shares with writers like Paulo Freire and Maxine Greene, there is no acceptable synthesis, no peaceful co-existence, between oppressors and oppressed. While according to Freire, the oppressed may internalize or house characteristics of the oppressor. In the global world of capital, the oppositional nature of the Other is replaced by niches or fragments, dissolving differences into marketing opportunities, really. Maryknoll, NY: Orbis Books, 2001. 276 pp.Why read Jacques Dupuis's Christianity and the Religions (2001) when his more comprehensive, ground-breaking Toward a Christian Theology of Religious Pluralism (Orbis, 1997) is still available? Father Dupuis reminds us in the introduction to Christianity that he has actually written three books (...) on the same subject—Jesus Christ at the Encounter of World Religions (Orbis, 1991) being the first—but he reaffirms the central importance of Religious Pluralism. After publication of this second work, his editors wanted another volume on the same topic, "less ponderous, more accessible, and aimed at an audience broader than the circle of specialists and the academy." That was the origin of Christianity and the Religions, a story Fr. Dupuis related to me when I visited him at Gregorian University in early February 2001. It was meant to be an easier-to-read version of Religious Pluralism, something for students who do not need abundant references to authors and historical developments. Circumstances, however, added another dimension to the need for yet another volume. [End Page 182]Christianity and the Religions was ready for publication in early 2001, but Fr. Dupuis was waiting for "official notification" from the Holy See's Congregation for the Doctrine of the Faith regarding its charges that Religious Pluralism contained "serious doctrinal error." By then, the case was in its thirty-second and final month, for later in February 2001 he received word from Cardinal Joseph Ratzinger, prefect of the Congregation, that the charge had been reduced to "ambiguities and difficulties on important points which could lead a reader to erroneous or harmful opinions." Dupuis last appeared before Cardinal Ratzinger and the Congregation's advisers on the day before Dominus Iesus was released in September 2000, accompanied by Fr. Peter-Hans Kolvenbach, superior general of the Jesuits, and Dupuis's advocate and colleague at the Gregorian University, Fr. Gerald O'Collins. Dupuis used the opportunity of a more accessible version of the book in question to address squarely the charges raised against him. He writes in the introduction to Christianity and the Religions: "Suffice it to say that in this new book I have scrupulously avoided all expressions that could raise any misunderstanding or create ambiguity over either the content of the faith or my thought." Dupuis dedicated the book to retired Cardinal Franz Kōnig. He chose to quote an earlier (1963) text by Cardinal Ratzinger on the page following the dedication: "What the Church needs today, as always, are not adulators to extol the status quo, but men whose humility and obedience are no less than their passion for truth: men who brave every misunderstanding and attack as they bear witness; men who in a word, love the Church more than ease and the unruffled course of their personal destiny." In 1999, Ratzinger and Kōnig had exchanged views, point and counterpoint, in the British Catholic weekly, The Tablet, over Dupuis's earlier Religious Pluralism.Fr. Jacques Dupuis died of an apparent stroke on 28 December 2004 at age 81. Although the investigation had brought him increased attention and invitations to speak, he was in Rome, his home since 1984, at the time of his death. When I visited him in 2001 and again heard him speak at the Catholic University of America just twenty-four days before his death, it was clear how much the case and accompanying suspicion had hurt him. Dupuis was principally a theologian who had considered it his good fortune to have lived and taught in India for thirty-six years. He also had taught theology for nearly fifteen years at Gregorian University, the premier university of his religious order. Many viewed the outcome of the investigation as a vindication of his work because he did not have to change a single sentence in Religious Pluralism for it to remain in publication, but the success of his defense came at a great price. Liberal democracy today, having aligned itself with capitalism, is producing a generalized feeling of weariness and disillusionment with government among the citizenry of many countries. Because of a decades-long march of globalized capitalism, economic oligarchies have gained oppressive levels of political power, and as a result, the economic needs of many people around the world have been neglected. It then becomes essential to remember that our ability to change society emerges from our power to formulate different questions; or, in this (...) case, alternative understandings of democracy. This book draws together a variety of alternative theories of democracies in a quest to expose readers to a selection of the most exciting and innovative new approaches to politics today. The consideration of these leading alternative conceptualizations of democracy is important, as it is now common to see xenophobic and racist rhetoric using the platform of liberal democracy to threaten ideas of plurality, diversity, equality, and economic justice. In looking at four different models of democracy this book argues that encounters with alternate conceptualizations of democracy is necessary if citizens and scholars are going to understand the constellation of possibilities that exist for inclusive, plural, economically equal, and just societies. One, it is said, went insane, another became a heretic, a third died and only (...) the fourth emerged unscathed. A modern variation of this story might go like this. Four or perhaps  philosophers entered the jungle of nationalism and for the most part went insane. There were those who embraced nationalism and consequently abandoned the universality of philosophy for the promotion of xenophobia, racism and even Nazism. Others remained internationalist and hence became futile—philosophical Canutes—commanding the raging beasts of nationality to be still. No one struggled harder with nationalism than Bertrand Russell. In , writing as an internationalist, he announced the demise of the principle of nationality only to see nationalisms explode in every region of the world (see his “National Independence and Internationalism”, Papers ). He opposed it relentlessly and without compromise until near the end of his life when he found himself endorsing wars of national liberation. Nationalism is often depicted as a howling beast. It would be better to think of it as an anaconda that wraps itself around everyone who ventures into its domain. Joan Cocks’ Passion and Paradox is an important book on nationalism and the intelligentsia. She traces the intellectual encounter with nationalism of a number of figures—Karl Marx, Rosa Luxemburg, Isaiah Berlin and the Scottish nationalist Tom Nairn, among others. All are exiles, most are Jews, and all try to hack their way through a jungle of conundrums of nationalist thought. Her accounts of these thinkers sometimes read like complex legal briefs, but are always illuminating. Though an internationalist, she sees the power of nationalist imperatives. Her approach to the contradictory strains of nationalism and hostility to nationalism echoes that of Hegel. She presents critical but sympathetic accounts of each side of the nationalist problematic and shows how their difficulties might be resolved in a higher synthesis. Alas! her resolution suffers from the unworldliness that she finds in other versions of internationalism. Her argument begins with a personal experience. In the early ’s she joined a group of Arabs and Jews against the Gulf War. In the course of their associ- Reviews  ation she learned that the Jews were all internationalists, while the Arabs were outspoken nationalists. This experience presumably demonstrated that a happy collusion of nationalism and internationalism was possible. But, of course, there was another side: those prosecuting the war she opposed were also nationalists. Her central thesis addresses the tragedy of opposition. It states that nationalism is “dilemmatic”, that is, that “all paths of thought obscured equally telling contrary thoughts; all courses of action were strewn with causes for regret and remorse” (p. ). The horns of the dilemma are the valid claims of the internationalist who sees the underlying self-destructive deep structures of nationalism on one side, and the claims of the national particularistic who is engaged in the compelling theatre of national liberation and the protection of local customs and roots on the other. Her book is an account of how her thinkers are framed by this dilemma, locked in by the imperatives of either side. In the period between the Gulf War and the composition of this book in  Cocks was able to observe what she identifies as the destructive logic of nationalism. The ’s were a period of postmodernist celebration of the local, a sensibility that helped to legitimate nationalism. The explosion of nationalism that followed the breakup of the Communist imperium was a time of liberation of the imprisoned nations—a springtime when it was good to be alive. But as the decade wore on the concealed pit bulls came out—in Yugoslavia, in Rwanda and elsewhere. In Cocks’ view nationalism showed an inner logic, of a sort that Russell called attention to in the early ’s—a logic that led from euphoria to self-destruction (see his Prospects). When evaluating the arguer instead of the argument, we soon find ourselves confronted with a puzzling situation: what seems to be a virtue in one argumentative situation could very well be called a vice in another. This paper will present the idea that there are in fact two sets of virtues an arguer has to master—and with them four sometimes very different roles.

The Water Margin is one of the four great classical novels of China. It describes how people from different walks of life were driven to become outlaws as a result of poor governance and widespread corruption. These outlaws have been regarded by some commentators as heroes, despite the fact that they perform wanton killing, over retribution, and cannibalism. Liu Zaifu 劉再復 argues that the novel has contributed to the moral downfall of the Chinese people. In this essay, I put (...) forward various arguments in objection to Liu. I think Liu’s argument is unsound, partly because he fails to address the nature of the cultural confrontation between modern readers and The Water Margin. By conducting an evaluation of Liu, I also consider a range of issues concerning how we may understand The Water Margin, and how the novel may morally relate to us in modern society. (shrink)

The potential use, relevance, and application of AI and other technologies in the democratic process may be obvious to some. However, technological innovation and, even, its consideration may face an intuitive push-back in the form of algorithm aversion (Dietvorst et al. J Exp Psychol 144(1):114–126, 2015). In this paper, I confront this intuition and suggest that a more ‘extreme’ form of technological change in the democratic process does not necessarily result in a worse outcome in terms of the fundamental concepts (...) of democracy and the Rule of Law. To provoke further consideration and illustrate that initial intuitions regarding democratic innovation may not always be accurate, I pose and explore four ways that AI and other forms of technology could be used to augment the representative democratic process. The augmentations range from voting online to the wholesale replacement of the legislature’s human representatives with algorithms. After first noting the intuition that less invasive forms of augmented democracy may be less objectionable than more extreme forms, I go on to critically assess whether the augmentation of existing systems satisfies or enhances ideas associated with democracy and the Rule of Law (provided by Dahl and Fuller). By imagining a (not too far-fetched) future in a (not too far-removed) democratic society, my conclusion is that, when it comes to democracy and the Rule of Law, intuitions regarding technology may lead us astray. The dichotomy (...) model faces binary associations head on, splitting existence however defined into dualisms like "this/that," "us/them," and "mind/body." Models of polarity, according to Jorgensen, accommodate dualities by buffering edges, emphasizing the interconnectedness of binary relationships. The fusion metaphor is exemplified by Paulo Freire's notion of praxis in which action and reflection are welded together to create hope for a new world, one free of the oppression and conflict that is inherent in binary relationships. The dialectical model is contrapuntal by nature, Edward Said would say.1This relationship highlights our postmodern devotion to différence by embracing the tension created through inclusion so that "this is with that," "we are with them and they are with us," and "mind is with body, just as body is with mind."2Perhaps there is a fifth model, a new kind of relationship where the oppositional or hierarchical nature of binaries co-exists peacefully without tension. This type of relationship is problematic philosophically, we will see, lacking as Jorgensen has outlined "logic evidenced in principles," "internal consistency," and "coherence within a unity or whole." Likewise for Bennett Reimer, this new mind-set fails the test of philosophical scrutiny, unconcerned as it is with a "reasoned, structured set of propositions."3 Whether philosophy or mind-set, this new arrangement has as much to do with freedom and free markets as it does with the particular conditions of both modernity and postmodernity.In the novel, White Noise, by Don DeLillo, the postmodern condition is represented in part by an "Airborne Toxic Event," a cloud of gas, Nyodene D, which floats above a tranquil All-American college town.4 A sense of crisis is felt, but felt obliquely and no one knows exactly what harm has been done. In Albert Camus' The Plague, by contrast, the disease that infests the North African town of Oran acts to awaken its citizenry, confronting the populace with the moral imperatives to fight or flee.5 Perhaps the metaphor of quarantine symbolizes the hard boundaries of modernism.Capitalism seeks to dissolve conflict. It operates silently, in the realm of social production, like a cloud of gas. Denise, Jack Gladney's daughter in White Noise, mumbles over and over in her sleep, "Toyota Corolla, Toyota Celica, Toyota Cressida...."6 There is a sense of ontological change, that the expanding reach of media, information, and technology rewires the way we think, the way we dream. Tensions are willed away. The expansion and survival of market shares, after all, depend on the peaceful erosion of boundaries—boundaries that demarcate what we learn, what we buy, and who we are.Questions about what this new system means—this new mind-set—are explored in a book called Empire by Michael Hardt and Antonio Negri.7 These writers posit a global world of communication, cooperation, and affect, where an increase in hybrids creates a kind of "omniversality" where the virtual, natural, and ideological converge.8 In the dialectical relationship that Jorgensen shares with writers like Paulo Freire and Maxine Greene, there is no acceptable synthesis, no peaceful co-existence, between oppressors and oppressed. While according to Freire, the oppressed may internalize or house characteristics of the oppressor. In the global world of capital, the oppositional nature of the Other is replaced by niches or fragments, dissolving differences into marketing opportunities, really. The paper was prompted by B. H. Suitsʼ construction of Utopia and solutions for the meaningful and happy life of every single human, presented in The Grasshopper: Games, Life and Utopia. The author considers, critically evaluates and confronts the role of human physical exercise and game-playing in four constructions of meaningful and happy human life, presented in three Renaissance philosophical writings: De optimo reipublicae statu deque nova insula Utopia libelous by T. More, La città felice by F. Patricius, and (...) Civitas Solis. Idea reipublicae philosophicae by T. Campanella, with the aforementioned B. H. Suitsʼ postmodern writing. The authorʼs thesis is that Suitsʼ solution to human meaningful and full life, which consists in constant game-playing or engaging in only autotelic and intrinsically valuable activities, contains all the leisured intentions of other considered constructions. Moreover, although Suits aims at contemporary humans, it is a solution for all historical periods, conditions or circumstances. (shrink)

The Anthropocene confronts environmental philosophy with one of the most urgent questions of the 21st century: How to maintain the earth’s condition in a way that allows current and future human generations to thrive? By asking such a question, ethical thought ceases to be solely a matter of individuality or morality. Instead, it raises a political issue: How can or should environmental philosophy relate to society in the Anthropocene? This article argues for a critical perspective that draws on contemporary historic (...) materialist scholars and politicises societal power relations. It exemplifies this approach by discussing key-terms of the Anthropocene discourse, like planetary boundaries, tipping points, and space-ship earth. Thomas Sheehan and Richard E. Palmer The materials translated in the body of this volume date from 1927 through 1931. The Encyclopaedia Britannica Article and the Amsterdam Lectures were written by Edmund Hussed (with a short contribution by Martin Heideg ger) between September 1927 and April 1928, and Hussed's marginal notes to Sein und Zeit and Kant und das Problem der Metaphysik were made between 1927 and 1929. The appendices to this volume contain texts from both Hussed and Heidegger, and (...) date from 1929 through 1931. As a whole these materials not only document Hussed's thinking as he approached retirement and emeri tus status (March 31, 1928) but also shed light on the philosophical chasm that was widening at that time between Hussed and his then colleague and protege, Martin Heidegger. 1. The Encyclopaedia Britannica Article Between September and early December 1927, Hussed, under contract, composed an introduction to phenomenology that was to be published in the fourteenth edition ofthe Encyclopaedia Britannica (1929). This paper is premised on the understanding that racism is deeply and widely entrenched in our culture and the ethical claim that we operate within complex networks of habituated practices. Within this framework, we ask how do we disrupt these calcified, complex, and racist ways of being? Specifically, we explore how teachers are habituated into particular ways of seeing and acting. We argue generally that conscious cultivation can promote greater equity and specifically that changing teacher talk is a necessary part (...) of this cultivation if racist norms are to be disrupted and replaced with more equitable ways of seeing in schools. In making this argument, we draw on a practice, Descriptive Inquiry, to cultivate more equitable talk and describe how it led to changes in four urban public schools. (shrink)

Lisa Lowe’s book addresses the colonial relationships that connect the continents of Europe, Africa, Asia and the Americas. These relationships of appropriation and dispossession are integral to liberal thought and, no matter how much it seeks to present itself as transcending these contexts, liberal thought is continually fractured by them. The book asks its readers to confront the formation of modern political subjectivity and its implication in the very disciplinary subjects through which we claim to know.

Writing deliberately in a nontechnical style so as to make his book accessible to readers who are not professional philosophers, Michael Gelven here offers an extended meditative essay on the nature and meaning of truth. He approaches this subject directly, rather than through a critique of what others have said about it, and takes off from the realization that truth has a wider meaning than that which can be found in the analysis of true sentences, which is the focus of (...) traditional epistemology. Pursuing philosophical inquiry as a voyage of discovery, the book begins with ordinary questions about the worth and meaning of truth. A fundamental distinction is drawn between the "true" and "truth" as essence, that which we confront as the ultimate terminus of our questioning—for example, between the true definition of mother as a female parent and truth as what we understand being a mother to mean, as one who sacrifices her own interests and safety for her child. In this article, we suggest that one of the unexplored paths toward collaboration between firms and civil society organizations starts with confrontation or potential conflict, and that the transition toward collaboration can be further understood if one focuses on triadic relationships rather than dyadic ones. We analyze the presence of third parties and their different roles to explain how collaboration is facilitated. The article aims at bringing together the bodies of research on business–civil society confrontation and on business–civil society collaboration. (...) It offers a comparative analysis of four case studies, and proposes a typology of third parties composed of facilitating allies, participating allies, mediators, and solution seekers. Confronting the threat of a Spinozistic necessitarianism, Leibniz insists that not all possible substances are compossible—that they can't all be instantiated together—and thus that not all possible worlds are compossible—that they can't all be instantiated together. While it is easy to appreciate Leibniz's reasons for embracing this view, it has proven difficult to see how his doctrine of incompossibility might be reconciled with the broader commitments of his larger philosophical system. This essay develops, in four sections, a novel solution (...) to the "puzzle of incompossibility." The first section frames the difficulty more carefully and briefly argues that the two dominant strategies developed by Leibniz's commentators fail to solve it fully insofar as they require simply abandoning one or another of its motivating commitments. The second and third sections show how Leibniz's guiding analogy of a geometrical packing or tiling problem may be applied to solve the puzzle of incompossibility in the context of finite and infinite worlds composed of extended corporeal substances. Finally, the fourth section shows how the strategy of Leibniz's packing analogy might be applied even in the context of a thoroughly idealist metaphysics in which the only true substances are nonextended, mindlike "monads." The essay concludes by drawing some connections between Leibniz's thinking about the puzzle of incompossibility and the development of his views concerning the status of corporeal substances and extended bodies. The four principles approach to bioethics, an approach most associated with the work of Tom Beauchamp and James Childress, is supposed to provide a framework for reasoning through moral issues in medicine. One might wonder, if one were to guide one’s thinking by the method suggested by principlism, will one identify and perform the objectively morally right action? Will one’s decision making be justified, and consequently, will the action that flows from that decision itself be justified? In this paper, (...) I show that principlism can, and has been, characterized in these two different ways. I also argue that when it is understood according to the first characterization, the view cannot be put into practice. However, when it is understood as an account of justification, there is reason to think that it is indeed action-guiding. Given the problems that confront the first version of the view, perhaps it is best to understand principlism, and biomedical ethical theories generally, not as action-guiding theories of right action, but rather, as procedures by which one’s decisions and actions in medicine can achieve a reasonable degree of moral justification. The four essays collected in this dossier are directed upon the contemporary understandings of blackness, as an ontology, a phenomenology, or a historicity. In the order of their presentation they encompass and situate what seems first to limit black being or overflow it, but which, when questioned, that is, disclosed, or unconcealed, does not fit into this logos, nor is ordered by it, even making what is most discernable about blackness in its past, future, or present, seem imaginary, moored (...) in a non-present,and presence, but in ways which make the non-being that marks blackness as sign, affect, or speaking being, unthinkable except as an appearing, a manifestation, an identity.As a dossier directed upon the present philosophical understanding of blackness, each paper seeks to unanchor blackness from the meanings and presuppositions that it normally calls forth. Beyond what is discernable, or ready-made, each paper addresses structures that make (and have made) blackness discernable as the always given to be seen, as meaningless speech, as pathology, as a concept beyond reason.The dossier opens with a question: what kind of disturbance does blackness present to being? Why does it seem to madden reason, or call forth frenzy? In Calvin Warren’s essay, “The Karen Call,” what comes into correlation with blackness are various kinds of emergency that structure white thought and presence but that belie witnessing and intelligibility, and in whose chain of significations can be discerned an ontological privilege that constitutes the world. To appear emergent, it seems, all blackness has to do is become one with the myth that bans or compromises it; a manifestation in which subject-object relations are already polarized by the dangers that deploy it in dramas of emergency. Once blackness becomes emergent, there is no escape, for it comes up against what Warren, reading Heidegger against the grain, suggests is a racial destiny of Being. To appear black is forthwith to resemble an es gibt that is indissociable from threat, falsehood, fantasy, and obliteration. To that extent, blackness attests to a kind of ontological emergency without surcease or hope, and one whose trace remains in every moment or glimpse; whose technical modality and structure always returns us to the call that is neither speech nor gaze, word nor symbol, but represents an extimacy that is undeconstructable, beyond utterance, meaning, or reparation.Such extimacy seems to induce a crisis in the philosophical notion of being itself. If blackness can only be presented as “paraontology,” a word that seems to shelter ontology at the same time as it presents the search for a new order of being, what does the para teach us about blackness as disorder, resistance, or identity? What is its philosophical genealogy and affiliation, and why does the para itself seem to never get beyond its own conciliation, or filiation to philosophy, whose ordering and racist historicity thereby remains the seme and mark of the para as interval, trope, and index? Or, put more simply, can blackness ever resist its own resistance as trope, conjuncture, or representation? Retracing that genealogy through the work of Oskar Becker, Karera uncovers a surreptitious repetition in black uses of the word, in whose weave can be discerned a fascist interference that not only undermines the fugitivity of the resistance so claimed, but one that unwittingly repeats a fascist ontology of world, history, and being.1 It’s a startling, deeply disturbing claim. But the apparent echoing of the Heideggerian bell in black significations of ontology suggests that what is being reabsorbed here is not so much a radical difference but a concept that remains justified and in fee to, pardoned and annulled by, a white notion of being. What, then, can it mean to think blackness as para? Nothing more than a philosophical confusion that confuses l’être qui fuit, that is, the lack that Lacan says cannot be completed or resisted, for an appositional fantasy of displacement. Here everything that is deemed black has to be made meaningful in apposition to ontology, but everything that is black must also, it seems, always return apposition to the white para of ontology; to be black and appositional would, it seems, produce only the disavowal of the philosophical genealogy that always already determines it.One would be right to distrust such claims—the moralism of the refusal, and the scandal of the faux resistance by which the para hides behind its own whited-out screen.In the third contribution to the dossier, the question asked is what would it mean for blackness to repair itself, to let go or retrieve and so redeem its own historical conjuncture? How do we refer to an irreparable past, that is, a past that keeps on coming back, but one that has no sign or signified, no memory that can recapture or reveal it, or simply rejoin us to it without remainder? Rinaldo Walcott’s essay, “‘Retrospective Significance,’” revisits the reparations debate as a question of black being. Instead of repair, he finds desolation and emptiness, or what he calls a staggeringly incoherent rhetoric of coherency. It’s a paradox that addresses what it means to remember or to forget a nothing; if blackness is nothing, how does one reconnect with it, bond with it, compensate it in its historic devastation? What would it mean to receive meaning from such devastation, to express it if this nothingness is absolute, or absolutely valueless? If ontology is a structure, then blackness, Walcott suggests, expresses nothing less than a “slave-ness” that continues to confront and disturb us absolutely, irrevocably. As such slave-ness is the trace that remains as a sign of the irreparable. As a trace, and not a sign, slave-ness becomes the primordial signifier of being, nation, history, and diaspora. But it is what makes it irrecuperable that defines its value and difficulty for the very language of reparation. Walcott pursues this difficult, enigmatic thread through the work of black thinkers on diaspora and identity. He concludes: black being cannot be dissociated from the disturbance it offers value, conscience, and any thought of alterity.The final and fourth contribution returns to the question of blackness as the trace or thread (the monstration) of being. How does one follow the thread (montrer) of blackness if it is always already withdrawn from being? David Marriott’s essay, “Ontology and Lalangue,” evokes Lacan’s concept of lalangue in pursuit of this enigmatic equivocation between letter and signifier, philosophy and psychoanalysis. Showing how both discourses have sought to master this exorbitance as master and/or free it as slave, I show how blackness is extinguished by the very words used to precipitate it into being. The slavish audacity of this lalangue is then shown to disarticulate, or more exactly, withdraw from ontology, but only so that whiteness can be presented and proclaimed all the more as the un-representable truth and logic of Dasein. This way of excluding blackness while preserving whiteness is not only central to philosophical and psychoanalytic understandings of language, Marriott argues, but this way of manifesting itself without manifesting itself is also crucial to the racialization of the logos as such.What is essential here is the way a meaning that is beyond meaning or representation is inserted into a problematic of mastery and servitude that advances-conceals a racial genealogy but in ways that makes the being of blackness an enigma. As such, blackness becomes an exorbitance that is always effaced in its monstration. More, its revelation must necessarily be unrecognized as the very locus of knowledge and truth. In that sense, what would it mean to figure, or to speak, this n’est pas without the consolation of being, meaning, truth, or logic? What would it mean to represent it as situated or defined by the language of ontology? Is black speaking being always in a relationship to and simultaneously the manifestation of a lalangue of lalangue? (shrink)

The confrontation between Philip the Fair and Boniface VIII has long been seen as a major turning point for the medieval papacy, for the rise of national monarchies, and for the political shaping of public opinion in late-medieval France. Philip's campaign to gain and display the support of the clergy, the nobility, and townspeople throughout the realm also generated a large body of documentation, much of which survives today. Although frequently explored and exploited during the last four centuries, the (...) archival record is not as straightforward as it appears. While recognizing it as part of a masterly propaganda campaign, one needs to look not simply at the shaping of opinion, but at the shaping of the written record—a case in which the silences, what is not recorded, are often as important as the voices on which our attention has been focused. But before turning to that issue, a brief review of events may be useful. (shrink)

All four of the articles in this issue concern thorny ethical questions around how we should care for and study highly vulnerable patients whose well-being is already deeply compromised: addicts and their families; gravely ill people considering death as an option; elderly people who have suffered loss of function; and premature infants. Dual loyalty issues confront health and welfare professionals in immigration detention centres in Australia. There are four apparent ways they deal with the ethical tensions. One group provides services as required by their employing body with little questioning of moral dilemmas. A second group is more overtly aware of the conflicts and works in a mildly subversive manner to provide the best possible care available within a harsh environment. A third group retreats by relinquishing employment in the detention setting. (...) A fourth group is activist in intent and actions. Derived from research and ethnography conducted in Australia, the article explores the moral dilemmas confronting those who are duty-bound by professional codes of ethics while also bound by loyalty to their employers and silenced by confidentiality statements. It provides particular focus on psychiatry, nursing and social work. We conclude by speculating whether a politics of compassion and acts of solidarity can forge a pathway through the ethical terrain. In doing so we draw upon human rights considerations as well as on the works of Joan Tronto and Elisabeth Porter. (shrink)

This paper confronts Zagzebski’s exemplarism with the intertwined debates over the conditions of exemplarity and the unity-disunity of the virtues, to show the advantages of a pluralistic exemplar-based approach to moral education (PEBAME). PEBAME is based on a prima facie disunitarist perspective in moral theory, which amounts to admitting both exemplarity in all respects and single-virtue exemplarity. First, we account for the advantages of PEBAME, and we show how two figures in recent Italian history (Giorgio Perlasca and Gino Bartali) satisfy (...) Blum’s definitions of ‘moral hero’ and ‘moral saint’ (1988). Then, we offer a comparative analysis of the effectiveness of heroes and saints with respect to character education, according to four criteria derived from PEBAME: admirability, virtuousness, transparency, and imitability. Finally, we conclude that both unitarist and disunitarist exemplars are fundamental to character education; this is because of the hero's superiority to the saint with respect to imitability, a fundamental feature of the exemplar for character education. Four recent books believe that we have entered the ‘era of populism’. After 30 years of neoliberal hegemony, we would now be living a new historical period in which political life would be more and more confrontational, personalized and emotional. Through a reconstruction of the main arguments of Ilvo Diamanti, Marc Lazar, Chantal Mouffe, Pierre Rosanvallon and Arnaud Zacharie, this article aims to highlight the accomplishments and the limitations of this historical diagnosis. Special attention is given to the fact (...) that, behind an apparent consensus, the theorists of the ‘populist moment’ disagree on several issues: the definition of populism, its relationship with political liberalism and the existence of a populist electorate. The bi-polar confrontation between the Soviet Union and the USA involved many leading game theorists from both sides of the Iron Curtain: Oskar Morgenstern, John von Neumann, Michael Intriligator, John Nash, Thomas Schelling and Steven Brams from the United States and Nikolay Vorob’ev, Leon A. Petrosyan, Elena B. Yanovskaya and Olga N. Bondareva from the Soviet Union. The formalization of game theory took place prior to the Cold War but the geopolitical confrontation hastened and shaped its evolution. In our article (...) we outline four similarities and differences between Western GT and Soviet GT: 1) the Iron Curtain resulted in a lagged evolution of GT in the Soviet Union; 2) Soviet GT focused more on operations research and issues of centralized planning; 3) the contemporary Western view on Soviet GT was biased and Soviet contributions, including works on dynamic stability, non-emptiness of the core and many refinements, suggest that Soviet GT was able to catch up to the Western level relatively fast; 4) international conferences, including Vilnius, 1971, fostered interaction between Soviet game theorists and their Western colleagues. In general, we consider the Cold War to be a positive environment for GT in the West and in the Soviet Union. (shrink)

Analyzes the moral problems confronting health care practitioners from a wide variety of perspectives, especially those connected by four major ethical principles--respect for autonomy, beneficence, non-maleficence and justice.

The article confronts Cornelius Castoriadis's philosophy of 'the imaginary institution of society' with issues of innovation in a knowledge society and outlines a new notion of innovation as creative organization. It will take a critical approach to innovation from a historical perspective of postwar systems theory and introduce Castoriadis's philosophy as an interesting option in this regard. It proceeds in four parts: (a) First, it debates the limits of the commonplace metaphor of diffusion and adoption in today's debate on (...) innovation. (b) Second, it will present aspects of Castoriadis's thought as an alternative, in particular his debate on imagination and the proto-institution of legein/teukhein — ordered action. (c) On this background it will treat a case from the Danish innovation industry, the firm Zentropa WorkZ's programme of 'Dramatic Innovation' as an interesting example of an innovation format addressing creativity. (d) In conclusion, it will briefly debate creative knowledge formation in a knowledge society by pondering relations between innovation and current science. (shrink)

The ABA has adopted four model policies that address, in one way or another, the issue of foreign lawyer mobility. These policies are the ABA Model Foreign Legal Consultant Rule, which is commonly known as the FLC rule, the ABA Model Rule for Temporary Practice by Foreign Lawyers, which is commonly known as the FIFO rule, ABA Model Rule of Professional Conduct 5.5, which permits foreign lawyers to serve as in-house counsel, and the ABA Model Rule on Pro Hac (...) Vice Admission. All four of the ABA's foreign lawyer mobility recommendations include a requirement that the mobile foreign lawyer is “ subject to effective regulation and discipline by a duly constituted professional body or a public authority .” In other words, these rules set forth requirements regarding the nature of the regulatory system in the foreign lawyer's home jurisdiction. A number of US states have included this requirement in their foreign lawyer mobility provisions, but a number have not. Although the ABA model rules and a number of state rules include this requirement, neither the ABA Model Rules nor any of the state rules have defined what it means for a foreign lawyer to come from a system with “effective regulation and discipline.” Nor is there any evidence that this requirement has been enforced in those states that have included this requirement. This article suggests that the “effective regulation and discipline” requirement has been an elephant in the room that no one has been willing to talk about. The article argues that the time has come to confront this issue head-on. It asserts that either efforts should be undertaken to define and enforce this requirement or that the requirement should be abandoned. The article reviews two “threshold” issues that jurisdictions might want to consider when deciding whether to adopt or retain an “effective regulation and discipline” requirement. It also identifies cross-cultural and cross-professional resources that might be consulted for “benchmarking” purposes if and when US regulators decide to add “meat to the bones” by defining and enforcing the “effective regulation and discipline” requirement found in foreign lawyer mobility provisions.
